States » North Posted at: Oct 10 2025 11:35PM Lucknow, Oct 10 (UNI) In a landmark judgment, the Uttar Pradesh Real Estate Regulatory Authority (UP-RERA), Principal Bench, has directed Azeagaia Development Private Limited, the promoter of the Azea Botanica housing project in Lucknow, to hand over the clubhouse and all common facilities to the Apartment Owners’ Association. The Authority ruled that these amenities are for the collective use of homeowners and cannot be retained or commercially exploited by the builder. The order came in response to a complaint filed by the Azea Botanica Apartment Buyers Association, which accused the promoter of unilaterally altering the approved layout plan. According to the association, the promoter had wrongfully attempted to classify the clubhouse and other common areas as “independent areas” to retain ownership and use them for commercial gain, actions found to be in clear violation of legal provisions. After a detailed hearing, UP-RERA concluded that the promoter’s actions infringed upon the rights of allottees and contravened the Real Estate (Regulation and Development) Act, 2016, along with state-specific rules and the Uttar Pradesh Apartment Act, 2010.
