Messages posted in a WhatsApp group of nine Endacom engineers were photographed from an absent colleague’s computer screen, passed up the management chain and then used as the basis for a summary dismissal. The Fair Work Commission has found the dismissal harsh, unjust and unreasonable and ordered Endacom Pty Ltd to pay $13,701.92 gross plus superannuation. The applicant had worked for Endacom as a project engineer on the Snowy Hydro 2.0 Project since 6 June 2022. On 29 October 2025 he gave eight weeks’ notice that he was resigning, with his employment to end on 24 December 2025. Endacom summarily dismissed him for serious misconduct on 3 November 2025. The termination letter pointed to “insulting and offensive messages” he had sent about his direct manager on 29 October 2025, before he gave notice, and the employer later also relied on messages said to encourage other employees to resign. The application for an unfair dismissal remedy under s.394 of the Fair Work Act 2009 was lodged on 13 November 2025.
