That section is controversial because, while it protects tech companies that are “platforms” from being liable from what others post, it has been stretched in recent years so that those companies now claim immunity even though they essential act as publishers and control what appears. In recent weeks, the companies even have been shown to be working directly with Washington, and following its instructions on what to censor, essentially becoming an extension of the government. Now the issue of that immunity has been opened up wide, with a decision by the 2nd U.S. Circuit Court of Appeals to throw out a panel decision upholding a lower court decision that affirmed those protections. It came in a case by Church United and Pastor Jim Domen. They sued Vimeo, a video platform, in January 2019 after the company censored content by terminating the church’s account. In 1990, the studio created a demo for a PC port of Super Mario Bros. 3. That demo is now in a literal museum. The Strong National Museum of Play, an institution in Rochester, New York, that chronicles the history of play — and also hosts the Video Game Hall of Fame — recently obtained a copy of that port, courtesy of an unnamed individual who sent in a larger trove of software. “The individual who donated it was a game developer,” Andrew Borman, the museum’s digital games curator, told Ars Technica. “It wasn’t something I expected to see in this donation, but it was extremely exciting, having seen the video Romero shared back in 2015.” (In 2015, John Romero posted a video on Vimeo detailing some of the demo’s levels and systems. A Lancaster University PhD Student and video artist has received international recognition for her work this month. Tess Baxter’s doctorate was awarded the Rieger Award by the International Visual Sociology Association, for the innovative way in which it connected how we use the internet with everyday life.Her work combines writing with 40 pieces of video art, and printmaking as well, to explore how people used the online virtual world of ‘Second Life’.Tess said: “I was interested in Second Life because it has now existed for 18 years, which is almost an eternity on the internet, and people have formed communities there. “Creativity is important, and very much shared among users, so I was able to use it creatively for my video art, which, in turn, I shared. “I feel very honoured to have been given this award. I would like to thank Professor Charlie Gere and Dr Jen Southern at Lancaster University for supporting me to do this. It’s been such a wonderful experience”.
