The Indian government in its response to WhatsApp’s lawsuit claiming tracing of encrypted messages violates the right to privacy of citizens highlighted the “international precedence” of such requirements. The government defended itself by saying that the ‘Five Countries’-- United Kingdom, United States, Australia, New Zealand and Canada -- are also in support of similar IT rules that give power to governments to intercept encrypted communications to protect citizens. Nagpur: Unidentified scamster duped a 65-year-old man of Rs 3 lakh by making a WhatsApp call using picture of victim’s friend as that of caller. Shrikrishna Murti Sadashivam, 65, a resident of 201, Ambedkar Sankul, Madhav Nagar, lodged a complaint on Tuesday about the fraud with Bajaj Nagar police station. Sadashivam stated he transferred the amount to the unidentified caller’s account between 11am of May 24 and 9.02am on May 25. The complainant received a WhatsApp call having display picture of his friend Shridhar Ayyar, who resides in the US, and thinking that it was him, he picked up the call. The call was disconnected and then Sadashivam received a WhatsApp message from the same number claiming to be his friend. It siad he had some urgent work in India and needed his help. The trickster shared different account numbers with the complainant in which latter deposited Rs 3 lakh some time later. Sadashivam then called up his friend in the US to confirm if latter had received only to be told that no call was made and no help was sought. “The complainant then realized he had been duped,” said a police official from Bajaj Nagar police station. WhatsApp has filed a legal complaint against the Indian government seeking to block regulations of the new IT rules that come into force today, Reuters reported.The lawsuit asked the Delhi High Court to declare that one of the rules, which come under the the IT Intermediary Guidelines and Digital Media Ethics Code Rules 2021, is a violation of privacy rights in India’s constitution as it asks social media companies to identify the “first originator of information” when authorities demand to know. The new rules could thus compel WhatsApp to break privacy protection.WhatsApp said that since messages are end-to-end encrypted, it would have to break encryption for receivers as well as originators of messages, even though the law required it to reveal only the people accused of wrongdoing. On an FAQ page on its website, WhatsApp said that traceability breaks end-to-end encryption and would “undermine the privacy” of people who communicate digitally. This could have a “chilling effect” on what people say and violate universally recognised principles of free expression and human rights, WhatsApp said.The company's complaint cites the Supreme Court's Puttaswamy judgement from 2017, where it upheld privacy as a fundamental right. Instant messaging platform WhatsApp approached the Delhi High Court Wednesday over the Centre’s new IT regulations, reports claimed.  Citing its sources, Reuters said, “WhatsApp has filed a legal complaint in Delhi against the Indian government seeking to block regulations coming into force on Wednesday that experts say would compel the California-based Facebook (FB.O) unit to break privacy protections.” The Centre’s deadline for digital platforms to accept its latest IT compliance requirements came to an end yesterday. While announcing the new IT rules on February 25, the Centre had said that if “significant social media intermediaries” failed to comply with the new requirements by May 25, they will lose their intermediary status. “Significant social media intermediaries” refers to those digital platforms which have more than 50 lakh registered users. The new IT guidelines require social networking sites and instant messaging platforms such as Twitter, Instagram, Facebook and WhatsApp to follow additional due diligence, including the appointment of a chief compliance officer, nodal contact person and resident grievance officer.
