Corbia, who has served for 10 years on the PC School Board, had defied the Superintendent, Mayor of Port Chester, and other officials and leaders in Village by not explaining racist, bigoted and insensitive Facebook posts attributed to his account, nor complying with his own vow to prove that his social media account had been hacked. The U.S. District Court for the District of Colorado appears to have beat the rest of the judiciary to the post-Facebook pleading stage punch in the form of a recommendation to allow an ATDS claim past the pleadings in Montanez v. Future Vision Brank Bank, LLC. The plaintiff alleged receiving “numerous telemarketing text messages” she claims were sent with “a combination of hardware and software systems” that had “the capacity to store telephone numbers using a random or sequential generator, and to dial such numbers from a list without human intervention.” None of the messages “were addressed specifically” to the plaintiff. Though the defendant shot back, arguing the plaintiff’s allegations were conclusory, the claim survived (for now). It follows two similar procedures, with at least two more surgeries planned. Alaina has severe burns from her head down past her knees, about 79% of her body. "She loved giving kisses," said Alaina's grandmother Karen Schultz. Schultz says doctors have told her it may be several months before Alaina can do that again. James McCartney used Facebook Messenger in an attempt to purchase a young girl so he could sexually assault her, Barrera says. “Pretty bizarre the way it all unfolded. It was very urgent,” Barrera said of McCartney’s attempt. Barrera explains McCartney messaged a female acquaintance asking if he could buy a little girl she knew. “The person who reported it to us was very upset, angry, mad... willing to go above and beyond to do whatever she could to help us,” Barrera said. Businesses using automated technologies to call and text consumers may breathe a collective sigh of relief today as the Supreme Court confirmed in the Facebook v. Duguid decision what defense lawyers have been arguing for years – equipment that is merely capable of storing and dialing telephone numbers is not an automatic telephone dialing system (“ATDS”) under the Telephone Consumer Protection Act (the “TCPA”).  Rather, the equipment must also use “a random or sequential number generator.”  That is the type of equipment that concerned Congress.  What is the TCPA? Enacted in 1991, the TCPA imposed restrictions on abusive telemarketing practices.  In particular, ATDS technology allowed companies to dial blocks of telephone numbers automatically, which could tie up the lines of emergency services and businesses alike.  In response to this emerging technology, the TCPA made it unlawful to make certain calls using an ATDS, and created a private right of action allowing consumers to recover up to $1,500 per unlawful call, creating the potential for truly staggering liability in class actions.   Facebook’s login notification text Fast forward 25 years.   » Read More
