hiQ and LinkedIn Reach Proposed Settlement in Landmark Scraping Case

Thursday, December 8, 2022 On December 6, 2022, the parties in the long-running litigation between now-defunct data analytics company hiQ Labs, Inc. (“hiQ”) and LinkedIn Corp. (“LinkedIn”) filed a Stipulation and Proposed Consent Judgment (the “Stipulation”) with the California district court, indicating that they have reached a confidential settlement agreement resolving all outstanding claims in the case. This case has been a litigation odyssey of sorts, to the Supreme Court and back: it started with the original district court injunction in 2017, Ninth Circuit affirmance in 2019, Supreme Court vacating of the order in 2021, Ninth Circuit issuing a new order in April 2022 affirming the original injunction, and back again where we started, the lower court in August 2022 issuing an order dissolving the preliminary injunction, and the most recent mixed ruling on November 4th, 2022. It certainly has been one of the most heavily-litigated scraping cases in recent memory and has been closely followed on our blog. NTIA delivers $67M to states in broadband planning grants – StateScoop

Written by Keely Quinlan Dec 8, 2022 | STATESCOOPThe National Telecommunications and Information Administration on Thursday announced another batch of broadband planning grants from the Biden administration’s “Internet for All” program, totaling nearly $67 million for 11 states and Washington, D.C. The announcements were the latest awards to come out of the $45 billion fund, which was created as part of last year’s infrastructure spending law. With Thursday’s awards, the NTIA has distributed nearly $150 million to 27 states and D.C. under the program. The grants draw on two components of the “Internet for All” program: the $2.5 billion Digital Equity Act, and the $42.5 billion Broadband Equity, Access and Deployment fund, the bulk of which will be distributed next year. The states included in Thursday’s funding announcement were Alaska, Arkansas, Colorado, Kentucky, Maine, Missouri, North Dakota, Pennsylvania, South Carolina, West Virginia and Virginia, in addition to D.C. The awards ranged between $2.9 million for Missouri and $6.6 million, which went to Pennsylvania. “Pennsylvania’s lack of affordable, accessible broadband is one of the biggest challenges holding our economy back,” Pennsylvania Gov. LinkedIn has announced some updated ad targeting options, as it works to align with evolving privacy regulations, while still providing optimal reach options for brand partners. First off, LinkedIn’s expanding its Group Identity audience targeting option to all ad types. Originally launched with selected partners last year, Group Identity enables you to target your ads based on LinkedIn data points. As explained by LinkedIn: “With Group Identity, we’re leveraging our first- and zero-party data, such as title, seniority, industry, interests, etc., to help you reach buying committees, measure your campaign performance, and optimize towards the objectives that matter to your business.” So you’re essentially putting more trust in LinkedIn’s system to get your ads in front of the right people, based on first-party attributes, as opposed to honing in your audience targeting through more specific, manually selected qualifiers. And it could be effective - LinkedIn says that Group Identity based campaigns have seen a 37% higher average click-through rate on group-delivered campaigns across channels. Credit: The Yomiuri Shimbun via AP Images In the first two years of the global pandemic, China’s model of lockdowns, mass testing and algorithmically-driven quarantine provided an alternative path for controlling Covid that effectively restricted the virus’s spread. Yet last week’s protests across several Chinese cities have shown the limits of the model, as the economy weakens and anger at the government’s restrictive policies boils over.  A root problem in current policy making is that decisions are increasingly made with scant regard to reality on the ground. In particular, the government has ignored the importance of consumption to growth and especially employment, the limited capacity of local residential committees to impose Covid-related rules, and the great potential of global pharmaceutical companies to help China with their proven vaccines.
