Paxton sues Meta, WhatsApp over alleged privacy violations – KVIA

AUSTIN (KVIA) -- Thursday, Texas Attorney General Ken Paxton filed a suit against Meta Platforms Inc. and WhatsApp. Paxton alleged the company misled consumers about privacy protections on the messaging app. WhatsApp is marketed as a "secure" messaging service by using end-to-end encryption. The encryption lets the sender and recipient access messages, but the platform itself can't. Attorney General Paxton alleges the security claims are inaccurate. He said reports imply WhatsApp employees have been able to access messages. “Texans deserve to know whether their private communications are indeed truly private,” said Attorney General Paxton in a statement. “WhatsApp markets its services as secure and encrypted, but it does not deliver on those promises. I am suing to protect Texans’ privacy and ensure that WhatsApp by Meta does not mislead Texans by unlawfully accessing private conversations and data.”  Paxton filed several lawsuits over privacy concerns, including against Netflix. He recently made a settlement with LG. Attorney General Paxton is currently challenging Senator John Coryn in the high stake Republican runoff for the 2026 U.S. Senate. The lawsuit, filed Thursday, claims WhatsApp falsely told users their messages were protected by end-to-end encryption — meaning only the sender and recipient could read them. The state argues Meta and WhatsApp still had ways to access some user messages despite those promises. “WhatsApp’s assurances are false,” the lawsuit read. “WhatsApp and its parent company, Meta, have access to virtually all of WhatsApp users’ purportedly ‘private’ communications.” According to court records, Paxton alleges WhatsApp marketed itself as a secure messaging app by telling users that “not even WhatsApp” could see their conversations. But the lawsuit alleges company employees and contractors were able to review certain messages. The lawsuit also cites a Bloomberg report from April about a federal investigation into WhatsApp’s privacy claims. According to the report, a Commerce Department investigator concluded there was “no limit” to the type of WhatsApp messages Meta could access. According to police, a case has been registered against an unidentified person at Hariparvat police station under relevant sections of Bharatiya Nyaya Sanhita (BNS) and an investigation has been initiated. Mr. Suman said he received the alleged death threat through a WhatsApp call on March 5, 2026, following which threatening and abusive messages were also sent from a mobile number via WhatsApp. The MP alleged that he had earlier received threats several times through social media platforms and had lodged a complaint with the Uttar Pradesh Director General of Police on March 8. He claimed that police registered the FIR only after nearly two-and-a-half months, which, according to him, reflected a lack of seriousness on the part of the authorities.
