On November 4, 2022, a California district court took up the parties cross-motions for summary judgment in the long-running scraping litigation involving social media site LinkedIn Corp.’s (“LinkedIn”) challenge to data analytics firm hiQ Labs, Inc.’s (“hiQ”) scraping of LinkedIn public profile data.  (hiQ Labs, Inc. v. LinkedIn Corp., No. 17-3301 (N.D. Cal. Nov. 4, 2022)). The court mostly denied both parties’ motions for summary judgment on the principal scraping-related issues related to breach of contract and CFAA liability.  While the court found that hiQ breached LinkedIn’s User Agreement both through its own scraping of LinkedIn’s site and using scraped data, and through its use of independent contractors (so-called “turkers”), who logged into LinkedIn to run quality assurance for hiQ’s “people analytics” product, there were factual issues surrounding hiQ’s waiver and estoppel defenses to its own scraping activities that foreclosed a judgment in favor of either party on that claim.  Similarly, the court found material issues of fact which prevented a ruling on hiQ’s statute of limitations defense to LinkedIn’s claims under the Computer Fraud and Abuse Act (CFAA) based on emails exchanged among LinkedIn staff back in 2014 about hiQ’s activities that may or may not have given LinkedIn

Pineapple, an app that’s aiming to reshape professional networking for Gen Z, is officially launching to the public today. The idea behind Pineapple is to give young professionals a way to network with others through a visual story profile that’s kind of like a digital portfolio. For now, the platform is only available on iOS. The professional network is the brainchild of Pineapple’s 22-year-old co-founder and CEO David Diamond, who got an early start in tech as a product design intern at Intercom at age 15. Diamond was initially rejected from Intercom after applying with a standard paper resume and was also told he was too young to work there. The Great Resignation has dominated the workplace for nearly two years — but employers may soon be able to heave a sigh of relief. The labor market is now "emerging from" the Great Resignation, LinkedIn's CEO Ryan Roslansky told CNBC Make It. The phenomenon — also known as the "Great Reshuffle" — refers to the mass exodus of workers during the pandemic.According to Roslansky, the year-on-year share of global LinkedIn members changing jobs has dropped from a high of 44% in September last year to -2% this year.Similarly in Asia-Pacific, the "job transition rate" has also drastically fallen in the same time period — from a peak of 83% to 4%, he added.In November alone, more than 20,000 U.S. tech workers were laid off, as internet giants Twitter, Meta and Salesforce downsized their workforce in the past week.Employees are acutely aware of this uncertain environment, too. Make way for the vaccine van. A new “pop-up” clinic makes getting the updated, bivalent COVID-19 booster shot even more convenient by bringing health-giving vaccines to the heart of campus. The pilot program, a collaboration of Yale Health, Being Well at Yale, and Yale School of Medicine’s Community Health Care Van (CHCV), held its first pop-up clinic Nov. 3 on Cross Campus, outside of Sterling Memorial Library. Health care practitioners vaccinated more than 250 students and staff on a first-come, first-served basis during the day. No appointments were necessary; participants signed up to get their vaccine booster on-site after a brief registration process. “We’re outdoors, we have a huge student turnout, and we’re making it easier for people to access the vaccine.
