Florida Sues Snapchat For Allegedly Violating New Child Social Media Law | 1290 WJNO

Photo: stockcam / iStock Unreleased / Getty ImagesFLORIDA - Florida Attorney General James Uthmeier has filed a lawsuit against Snap Inc., claiming the company is violating a new state law designed to limit social media access for children under 16. The legal complaint, filed in Santa Rosa County, alleges that Snapchat is providing accounts to users under age 14 and failing to obtain parental consent for those aged 14 and 15, actions that allegedly breach House Bill 3, passed in 2024. The law prohibits children under 14 from creating social media accounts and requires parental approval for teens aged 14 and 15. Although the law does not name specific platforms, it applies to those that include addictive elements such as algorithms, content feeds, and disappearing messages. The lawsuit asserts that Snapchat’s push notifications and disappearing content qualify it under the statute. According to the filing, Snap allegedly continues to allow minors to join the app without proper age verification or parental consent, which the state argues amounts to deceptive trade practices under Florida law. The complaint seeks penalties of up to $50,000 per violation and a court order to halt the company’s alleged noncompliance. Snap Inc. has not publicly responded.

Florida Sues Snapchat, Alleging Social Media Platform Is Not Blocking Minors | FlaglerLive

Florida’s preferred chat box. Photo by inni w on Unsplash Florida Attorney General James Uthmeier has filed a lawsuit alleging that the operator of Snapchat is violating a high-profile 2024 law aimed at keeping children off some social-media platforms. The lawsuit, filed Monday in Santa Rosa County circuit court, came after a federal judge last month rejected a request by tech-industry groups for an injunction to block the law. In a federal-court filing Monday, attorneys for the state said Uthmeier “expects that additional investigations and enforcement actions will commence soon.” The law (HB 3) seeks to prevent children under age 16 from opening social-media accounts on platforms that meet certain criteria — though it would allow parents to give consent for 14- and 15-year-olds to have accounts. Children under 14 could not open accounts. Supporters of the law have said it targets addictive features of social-media platforms — a key argument in the lawsuit that Uthmeier filed Monday against Snap Inc., which operates Snapchat. “Despite being subject to HB 3, Snap contracts with and provides accounts to Florida users who it knows are younger than 14,” the lawsuit said. “It also fails to seek parental consent before contracting with and

Florida attorney general sues Snapchat for allegedly ‘exploiting’ minor users

Florida Attorney General James Uthmeier filed a lawsuit accusing Snapchat’s operator of illegally marketing addictive design features to minors.  Under a 2024 Florida law, HB 3, social media platforms that use “addictive features” are prohibited from providing accounts to children 13 or younger and must restrict access to 14 and 15-year-olds. Snapchat utilizes several of these “addictive” features that “exploit” minors, Uthmeier alleged, including infinite scrolling, push notifications, certain personal interactive metrics such as SnapStreaks, and auto-play videos. Uthmeier argued that Snap, Inc. had violated the law by “market Snapchat in Florida as safe for users as young as 13.”  “Despite being subject to HB 3, Snap contracts with and provides accounts to Florida users who it knows are younger than 14,” read the lawsuit filed Monday in Santa Rosa County circuit court. “It also fails to seek parental consent before contracting with and providing accounts to Florida users who it knows are 14 or 15 years old. Snap is openly and knowingly violating HB 3, and each violation constitutes an unfair and deceptive trade practice under FDUTPA .” In a statement on Tuesday, Uthmeier accused Snapchat of “deceiving Florida
